Trade agreement between the government of His British Majesty and the government of the Russian Socialist Federative Soviet Republic.
In view of desirability, in the interest of how. Russia and the United Kingdom, the resumption of peaceful trade relations between these countries, and since for this purpose, until the conclusion of a formal common Peace Treaty between the Governments of both countries, which will regulate their economic and political relations in the future, it is necessary to reach a preliminary Agreement between the Government The United Kingdom and the Government of the Russian Socialist Federative Soviet Republic, hereinafter referred to as the Russian Soviet Government, then,
the aforementioned parties have concluded, according to this, this Agreement on the resumption of trade relations between the two states.
A... It has been established that the expression "conducting any official propaganda" includes the provision of one or the other of the parties to help or encourage any kind of propaganda conducted outside its own boundaries.
The parties undertake to immediately give all the necessary instructions to their agents and all persons subordinate to them on the observance of the adopted and the above-mentioned regulations.
I. Both sides agree not to establish or maintain in any form a blockade against each other and to remove immediately all obstacles that have hitherto been placed in the path of the resumption of trade between the United Kingdom and Russia in all kinds of goods that can be legally exported from their respective territories to any foreign states or imported into their respective territories from any foreign states, and not put this trade in worse conditions in comparison with trade conducted with other states, as well as not pose any obstacles to banking, credit and financial transactions carried out in the purpose of this trade, with the indispensable, however, the application of laws in general, in force in each country. Nothing said in this article can be interpreted in the sense of repealing the provisions of any general International Convention binding each of the parties, governing or having in the future to regulate trade in any particular commodity (such as the Opium Trade Convention).
II. British and Russian ships, their captains, crew and cargo will enjoy in the ports of Russia or the United Kingdom, by belonging, in all respects, the same treatment, advantages, conveniences, exemptions and patronage that are usually accorded, according to the established practice of trading nations, to those visiting their ports. foreign merchant ships, their captains, crews and cargoes, including the commonly provided services for the supply of coal and water, in relation to pilotage, anchorages, dry docks, cranes, repairs of warehouses and all general services, fixtures and premises related with commercial shipping.
In addition, the British Government undertakes not to participate in and not to provide its support to any measures that restrict, or impede, or are aimed at limiting or hindering the exercise by Russian ships of their right to freely sail on the high seas, straits and navigable waterways that are used ships of other nations.
However, nothing in this article restricts the right of either party to take precautions, permitted by their respective laws, in relation to the admission of foreigners to their territory.
III. Since the British and other Governments have already begun, for the benefit of all peoples, to cleanse the seas that wash their own beret from mines, as well as the known parts of the Baltic Sea, the Russian Soviet Government, for its part, undertakes to clear the sea routes to its own ports.
The British Government will give the Russian the Soviet Government all information available to it on the location of mines, which can facilitate the clearing of the routes to the ports and to the shores of Russia. The Russian Government, like other peoples, will provide the International Commission for Catching Mines with all information about the areas it has swept, as well as about areas that still continue to be dangerous. It will also provide all information in its possession regarding the minefields placed by the previous Russian Governments outside Russian territorial waters since the outbreak of the war in 1914 in order to facilitate their removal.
It has been established that nothing in this section will be understood in the sense of preventing the Russian Government from taking whatever measures it deems necessary to protect its ports, or in the sense of requiring it to disclose such measures.
IV. Each party may designate its citizens in an amount which may from time to time be established by agreement, as reasonably necessary for the proper implementation of this Agreement, and the conditions under which trade is carried out in the territory of that party must be taken into account, while the other party will permit such persons to enter their territory, stay in it and engage in trade there, provided that each party can restrict the admission of each of such persons to any specific areas, as well as may refuse admission and stay on its territory to any person personally recognized by it for himself "persona non grata" or for not complying with this agreement or the conditions set out in the Introduction.
Persons admitted as a result of this article to the territory of the other party will be exempted during their stay there on commercial matters from all kinds of compulsory civil, naval, military or other service and from all kinds of taxes in cash or in kind imposed instead of personal duties, and will also be enjoy the right to exit.
They are allowed to communicate freely by mail, telegraph and wireless telegraph, as well as to use telegraph codes, in accordance with the conditions and rules set forth in the St. Petersburg International Telegraph Convention of 1875 (revised in Lisbon in 1908).
Each party undertakes to make calculations to establish balances and pay for them for final and transit telegrams and for transit mailings, in accordance with the provisions of the International Telegraph Convention and the Order, as well as the Convention and the Order on the Universal Postal Union, as appropriate.
The above balances, if they are passive, will be paid in the currency of any contracting party, at the option of the party receiving the payment.
Persons admitted to Russia under this Agreement will be allowed to import items (with the exception of items such as alcoholic beverages, importation, as well as the production of which in Russia is prohibited or may be prohibited) intended solely for their household use or consumption, into quantity normally required for this need.
V. Each contracting party may appoint one or more official agents, in an amount not exceeding that to be established by mutual agreement, to stay and exercise their functions in the territory of the other party. These agents will personally enjoy all the rights and benefits listed in the previous article, as well as protection from arrests and searches, so that each party can refuse to admit as an official agent any person who is personally “persona non grata” for it, or may invite the other party to withdraw it if it finds it necessary to do so for reasons of public benefit or safety. These agents will have access to the authorities of the country in which they are staying in order to facilitate the implementation of this Agreement and in order to protect the interests of their fellow citizens.
Official agents will be able to communicate freely with their Government and with other official representatives of their Government in other states by mail, telegraph and wireless telegraph in cipher, as well as receive and send couriers with sealed, seized packages, the weight of which is limited to 3 kilograms in Week.
Telegrams and radio telegrams from official agents will enjoy all those priority rights over private items that may generally be accorded to items by official representatives of foreign Governments in the United Kingdom or Russia, respectively.
Russian official agents in the United Kingdom will enjoy the same exemptions from state and local taxes that are accorded to officials of other foreign Governments.
British official agents in Russia will enjoy equal privileges, which in any case cannot be less than those accorded to official agents of any other country.
Official agents will be authorized to endorse the passports of persons wishing to be admitted on the basis of the previous article in the territory of the contracting parties.
Vi. Both parties generally undertake to ensure that persons admitted to their territory on the basis of the two previous articles will enjoy all kinds of patronage, rights and amenities necessary to enable them to trade, subject to the indispensable, however, compliance with all laws generally in force in the subject countries.
Vii. Both contracting parties agree, simultaneously with the conclusion of this Trade Agreement, to resume the exchange of private postal and telegraph correspondence between both countries, as well as the sending and receiving of radio telegrams and postal parcels, in accordance with the rules and regulations. existed until 1914.
VIII. Passports, identity cards, powers of attorney and similar documents issued or certified by the relevant authorities in one of both states for the purpose of exercising the possibility of commercial relations under this Agreement will be accepted in the other state in the same way as if they were issued or certified by the authorities of a recognized foreign government.
IX. The British Government declares that it will not initiate any steps aimed at the seizure or seizure of gold, money, cash or goods that cannot be identified as the property of the British Government, and which would be exported from Russia in payment for the importation of goods, or to secure such payment, as well as the arrest or seizure of any other movable or immovable property that would have been acquired by the Russian Soviet Government within the United Kingdom.
It will not take steps to enact any special laws not applicable to other countries and directed against the import into the United Kingdom from Russia of precious metals, whether in coins (other than British and Allied ones), in bullion or in articles, or against storing, analyzing, refining, smelting, mortgaging or disposing of them in the United Kingdom, and will not requisition such metals.
X. The Russian Soviet Government undertakes not to present any claims to the disposal, in any way, of the capital or other property of the former Imperial and Provisional Russian Governments located in the United Kingdom. The British Government makes a corresponding commitment regarding the capital and property of the British Government located in Russia. This article does not preclude the inclusion in the General Treaty referred to in the Introduction of any provisions concerning the subject matter of this article.
Both parties agree, pending the conclusion of the aforementioned Agreement, to protect all the aforementioned capitals or property that may be within their disposal and not to transfer them to any plaintiffs.
XI. Goods manufactured or manufactured in one of the countries imported on the basis of this Agreement to another will not be subject to compulsory requisitions there by the Government or any local authorities.
XII. It is recognized that all questions concerning the rights and claims of citizens of one of the parties: in relation to patents, trade marks, designs and artistic and literary property in the territory of the other party, will be fairly resolved in the Treaty referred to in the Introduction.
X III. This agreement will enter into force immediately and both parties should immediately take all necessary steps to implement it. It will remain in effect until it is superseded by the Treaty provided for in the accession, since both parties will comply with the conditions set out in both the Articles of the Agreement and the Accession.
At the same time, at any time after the expiration of twelve months from the date of entry into force of the Agreement, each party may make a declaration on the termination of the provisions of the previous articles and, after six months from the date of such declaration, the effect of these articles will accordingly cease:
In the event, also, if, as a result of any claim brought in the court orders of the United Kingdom for the detention or seizure of any gold, money, securities, property, or goods that cannot be identified as constituting the exclusive property British subject and who are sent to the United Kingdom by the Russian Soviet Government or its representatives, the court will make a decision according to which this gold, money, securities, property and goods are actually detained in order to turn to settlements for obligations assumed by the Russian Government or what - either by the previous Russian Government prior to the day of signing this Agreement, then the Russian Soviet Government will have the right to terminate the Agreement immediately.
In addition, also, in case of violation by one of the parties at any time of the provisions of the Agreement or the conditions specified in the Introduction, the other party will be immediately free from the obligations of the Agreement. However, it is recognized that, prior to taking any action incompatible with the Agreement, the injured party will provide the other party with a reasonable opportunity to provide an explanation or correct the violation.
It is mutually recognized that in all cases provided for by the previous conditions, the parties will provide all necessary assistance for the liquidation, in accordance with the principles of this Agreement, of all transactions already concluded by virtue of its transactions, as well as for the recall and departure from their territory of citizens of the other party and for export their movable property.
From the date of the statement, in accordance with this article, a preliminary, six months in advance, refusal, it is allowed to conclude on the basis of this agreement only such transactions that can be completed within six months. In all other respects, the provisions of this Agreement will remain in full force and effect until the date of termination of the Agreement.
XIV. This agreement has been drafted and signed in English. But it was established that a Russian translation should be made and agreed between both parties as soon as possible. Both texts will then be recognized as authentic in all respects.
